Before Your Tenancy Begins

To secure your rental property, you’ll need to pay a Holding Deposit equivalent to a maximum of one week’s rent (Payable to Scarlet Oaks Estates & Lettings). This deposit applies per tenancy and will later be deducted from your total deposit.

Please note that this deposit may be non-refundable under the following circumstances:

  • If any false or misleading information is provided on your application and discrepancies arise during third-party reference checks.
  • If you choose not to proceed with your application or fail to sign the tenancy agreement within 7 working days (unless an extension has been mutually agreed).
  • If any applicant fails the Right to Rent check, as required by UK law.

However, in the unlikely case the landlord is unable to proceed with the tenancy for reasons unrelated to your application, the holding deposit will be fully refunded.

Deposit – Equivalent to 5 Weeks' Rent

Once all reference checks have been successfully completed and passed, a deposit equivalent to 5 weeks’ rent will be required. This deposit serves as security for any potential damages, dilapidations, or defaults caused by the tenant during the tenancy.

The holding deposit paid to secure the property will be deducted from this total, with the remaining balance to be paid along with the first month’s rent. Both the deposit and the first month’s rent must be paid in full after the tenancy agreement has been signed and before the keys are handed over to the tenant.

In compliance with UK law, all deposits are protected under the Deposit Protection Scheme (DPS). This ensures that your deposit is securely held and safeguarded throughout the tenancy period, protecting both tenant and landlord.

At the end of the tenancy, following a property inspection, any necessary deductions for damages or outstanding rent will be made, and the remaining deposit will be returned to the tenant in accordance with DPS regulations.

This provides peace of mind, ensuring the property is well-maintained and all obligations are met.

Late Rent Payments and Arrears

In the unfortunate event that rent payments are not made on time, tenants will be liable for interest on the overdue amount. The interest rate is set at 3% above the Bank of England’s base rate for any rent that remains unpaid after 14 days.

This charge will accrue daily until the full outstanding amount is settled. We encourage tenants to communicate with us promptly if they are experiencing any financial difficulties, as addressing arrears quickly helps avoid additional charges and potential legal consequences.

Maintaining clear communication can often lead to a resolution, and we’re always here to assist wherever possible.

Contract Amendments (At Tenant’s Request, Subject to Landlord Approval)

If you need to request changes to your tenancy agreement, we’re here to help. Common adjustments may include adding or removing occupants or updating names.

To initiate a change, submit your request in writing, detailing the modifications you seek. We will then contact the landlord to discuss your proposal.

A fee of £100 will apply to cover our work in obtaining landlord approval and preparing the necessary legal documents. This fee also includes updating our internal systems to reflect any changes accurately. While we facilitate the process, the final decision rests with the landlord.

Replacement of Keys or Security Devices

If you lose a key or security device, you will be required to cover the replacement costs. Should the lost item necessitate changing the locks, you will be responsible for the locksmith fees, the cost of a new lock, and providing new keys for all relevant parties, including the landlord. This helps maintain the security of the property for everyone involved.

Early Termination of Tenancy

Early Termination of Tenancy

 If you are granted permission by the landlord to vacate the property before the end of your tenancy agreement, you may be responsible for several costs.

Please note that the landlord has the final say in any early termination request. If the landlord declines your request, you will remain liable for the full rent, council tax, bills, and any other charges outlined in your tenancy agreement for the remainder of the tenancy.

If the landlord agrees to an early termination, you may incur costs related to the landlord’s expenses for re-letting the property. Additionally, in some circumstances, there may be a fee payable to the agency for facilitating this process.

However, please be assured that these costs will not exceed the maximum amount of rent outstanding at the time of your early release.

Supplementary Payments

Tenants may incur additional charges not previously mentioned, especially in instances of contract breaches or as specified in relevant legislation, which may encompass contractual damages.

It’s crucial to note that if you report a maintenance issue and a contractor is dispatched to evaluate it, you will be responsible for the costs if it is found that the issue was caused by you or an associate, or if no fault is identified. Scarlet Oaks Estates & Lettings reserves the right to deduct any unpaid charges from your deposit in such cases.
